Disney's got a problem on their hand. Remember, this movie was supposedly green lit for a sequel after it's Premiere Access run, too.
Disney broke their contractual agreement in both cases. Both movies were made in like 2019 or so when theaters were doing great, Disney+ hadn't launched yet, and no one saw Covid coming. Because of this, their contracts were very specific. (at least in scarlett's case) that it was to be a Theatrical exclusive movie and her bonuses were tied to the box office performance, which was probably the same for Emma.Realistically, what are the chances of either of them winning?
This seems like a settle out of court situation. Again, Disney broke their contract and they have been unwilling to renegotiate according to Scarlett. I get that Covid happened, but a contract is a contract. They waited forever to release The New Mutants when they did because the Director had a Theatrical Exclusive clause in his contract, it should be no different here.
This is a mess created by the new orders by Chapek. I expect things will be handled behind closed doors as everything playing out in public like this is not good for Disney from a PR perspective. Hell, Disney's PR response about the lawsuit yesterday was trash. No one is going to feel bad for Disney.

And Covid has absolutely nothing to do with the agreement they came to in 2017 apparently. Yes, Covid complicated things with the film, but that's when you renegotiate if you want to put it on Disney+ with Premiere Access. I'm not sure the breakdown of theatrical release revenue vs D+...but I don't think it is about compensation, rather principle.

If Disney wins, a lot of their talent will be looking over their contracts and it will be public knowledge that they treat their talent like garbage.
