I expect some deal will quietly be worked out, either involving the gentleman in question receiving some financial reimbursement or perhaps acknowledgement somewhere in the film's credits.
This kind of stuff is not all that uncommon, really. Harlan Ellison, for example, took action against James Cameron and the production company behind THE TERMINATOR because Cameron was... well, let's say influenced by an episode of THE OUTER LIMITS that Ellison contributed to. As such, Ellison now receives a credit on the home video versions of the movie.
In any case, I'd wager any controversy surrounding the new Kong film will be fairly contained, and have little impact on the film itself, much less the ride, which is only tangentially connected.
